Gift Cards Terms of Use

1. By purchasing, redeeming or attempting to redeem a  Norman Ross Gift Card (“Gift Card”), a person accepts and agrees to these Terms of Use. 2. Gift Cards are issued by Norman Ross Limited NZCN 1934371 (“Issuer”) and are redeemable for goods and/or services at any Norman Ross store in New Zealand. 3. Gift Cards hold no value unless activated in the Issuer’s Gift Card System (“System”). 4. Gift Cards expire 24 months from the date of issue and will not be reissued once expired. Any balance remaining on a Gift Card will not be redeemable for use once expired. 5. On presentation of a Gift Card to a Norman Ross store in unaltered form, and without any fraudulent use, the Issuer will procure the Norman Ross store to provide credit to the bearer up to the value or balance of the Gift Card as identified on the System, against the purchase price due to the Norman Ross store. If the purchase exceeds the value or balance of the Gift Card, the bearer must pay the excess using another payment method. No change will be given and any balance of the Gift Card may only be used in whole or part against future purchases. 6. Gift Card balance, transaction history and expiry date may be verified in any Norman Ross store. 7. The Gift Card: (a) may not be used for purchases made over the Internet or by email, phone or fax; (b) will be void once the value or balance of the Gift Card has been fully redeemed; (c) is not redeemable for cash; (d) cannot be exchanged for a different brand, denomination or type of Gift Card; (e) is issued without alteration and will be immediately void if altered or defaced; (f) must be treated as cash as it will not be reissued, refunded or honoured if lost or stolen; (g) will not be reissued, refunded or honoured if found to be faulty or damaged unless the Gift Card is proven to be faulty or damaged due to the fault of the Issuer or a Norman Ross store; (h) will not be redeemable if presented to a Norman Ross store by a person other than the person whose name the Gift Card has been activated in (“original bearer”) and where that person is unable to verify to the reasonable satisfaction of the Norman Ross store that they are authorised to redeem the Gift Card on behalf of the original bearer; (i) and at all times, remains the property of the Issuer. 8. Gift Card bearers may be required to provide satisfactory proof of identity. 9. In some circumstances, the Issuer may collect personal information for the purpose of issuing a Gift Card. A copy of the privacy policy is available in store. 10. The Issuer reserves the right to amend these Terms of Use at any time without notice. 11. To the extent permitted by law, the Issuer is not liable to any person for any loss or damage (whether direct or consequential), nor will they be in default under these Terms of Use, for failure to observe or perform any of their obligations under these Terms of Use for any reason or cause which could not, with reasonable diligence, be controlled or prevented. 12. These Terms of Use are governed by and construed in accordance with the laws of New Zealand and the non-exclusive jurisdiction of the courts of New Zealand will apply where there is any dispute. 13. Any complaints about the Gift Card or goods or services purchased with a Gift Card may be resolved at any Norman Ross store.
